– Terms & Conditions of Sale

1. Introduction

a) In these Terms, “we”, “our” or “the Company” refers to Furnish & Fettle Ltd. “You” or “the Customer” refers to the person or business placing the order.

b) These Terms do not affect your statutory rights.

2. Basis of Agreement

These Terms set out the agreement between Furnish & Fettle Ltd and the Customer. Any amendments must be confirmed in writing by us. Verbal statements or informal assurances given by our staff or representatives will only be binding if confirmed in writing.

3. Products

We will provide the furniture, furnishings and/or products ordered in line with your instructions.
Our commitment is that the goods will be of satisfactory quality and suitable for the purpose communicated, subject to the following:

  • Our design team exercises its judgment to show fabrics and products in their best form, within the natural limits of design and materials.

  • Certain designs, shapes or materials may limit exact placement of patterns or detailing.

  • Natural materials such as timber and stone may vary in colour, movement and markings over time – these variations are not faults.

  • Any issues or defects must be reported in writing within 14 days of delivery.

  • Timber may naturally release resin; we cannot guarantee against this.

  • Products must be cared for in line with the care advice provided to maintain any guarantee.

  • Items installed by tradespeople not appointed by us are covered only by the manufacturer’s warranty. We cannot extend cover to third-party installations.

  • Finishes (including metals) may differ from samples; this is outside our control.

4. Delivery

a) We aim to deliver within agreed timeframes but cannot guarantee specific dates. Delays outside our control may extend delivery times without giving grounds to cancel.

b) Prices are based on full delivery of the order. Additional charges may apply for split deliveries requested by the Customer.

c) Any shortages or damage must be reported in writing within 24 hours of delivery.

d) If you are unable to accept delivery, we may arrange storage and insurance, charging you for the associated costs.

e) Cancelling a booked delivery within seven days may result in an £80 cancellation fee.

f) It is your responsibility to ensure items fit into your property. Any adjustments needed to facilitate delivery will be at your cost.

g) Standard delivery assumes normal access. Difficult or restricted access must be highlighted in advance; additional charges may apply for extra time, staff or equipment.

h) Should goods be damaged on delivery by us, and replacement or repair is not possible for reasons outside our control, we may refund the purchase price instead.

5. Project Work

a) Where applicable, we will share a project schedule with indicative dates. These are a guide only and may shift due to unforeseen circumstances.

b) Property access arrangements must be agreed in writing prior to work commencing. We take care with your property but cannot be held responsible for overall site security unless otherwise agreed.

c) Snagging will be addressed as part of the agreed works, usually within 3 weeks of completion.

d) A 6-month warranty applies to completed projects (excluding products covered by separate manufacturer warranties such as appliances). Beyond this period, any further work will be quoted separately.

6. Payment

a) Payment is required in full within 7 days of delivery. Late payments will incur interest at 4% above the Bank of England base rate, calculated daily.

b) Ownership of goods remains with us until full payment is received.

c) The risk of accidental damage or loss passes to you upon delivery.

d) If payment is overdue, we may recover goods supplied and you will be responsible for any costs incurred in doing so.

7. Cancellations & Deposits

a) Orders are only accepted once a deposit has been received. Unless otherwise agreed, this deposit will usually be 50% of the total order value.

b) As most items are made to order, cancellations may result in charges equal to costs reasonably incurred by us up to the date of cancellation.

c) Deposits will be offset against these costs. Any balance of deposit remaining will be refunded.

d) If we cancel your order (through no fault of yours), we will refund deposits and cover reasonable costs incurred by you.

e) Deposits retained following cancellation cannot automatically be applied to future orders unless expressly agreed in writing.

8. Product Quality & Guarantees

a) If notified of a defect, we will choose to repair, replace, or refund the affected goods.

b) Our liability is limited to the value of the goods (including related delivery or transport costs). We will not cover indirect or unforeseeable losses.

c) Colour consistency can only be assured if all items are ordered at the same time. Reasonable variations may occur in size, shade or finish.

d) If a fabric, finish, or product is discontinued, we will aim to repair or cover the item with the closest available match – but cannot guarantee an identical replacement.

e) Customer-supplied fabrics or products are used at your risk, and we do not guarantee their suitability or durability.

f) “Sold as seen” items are non-returnable and non-refundable. Any visible faults identified at purchase are excluded from warranty.

g) Neither party will be held liable for delays or failures caused by circumstances beyond their reasonable control.

h) Nothing in these Terms excludes our liability for death or personal injury caused by negligence.

9. Wallpaper Orders

a) Wallpaper rolls are non-refundable once ordered.

b) Our team will, if requested, estimate the number of rolls required using the measurements you provide and an online manufacturer’s calculator.

c) While every effort is made to ensure accuracy, we cannot be held responsible for any discrepancies between the estimated and actual quantities required.

d) Please ensure all dimensions supplied are correct before ordering.

10. Bespoke, Made-to-Order & Special Orders

a) Bespoke or made-to-order items, and any products ordered specially for a client, are non-returnable and non-refundable, unless faulty.

b) This includes items made to specific sizes, finishes, or upholstery requirements.

c) These Terms do not affect your statutory rights in respect of faulty or misdescribed goods.

11. Pricing

All prices are quoted in good faith. If an error in pricing is discovered within 14 days of your order, we will notify you and offer the option to reconfirm or cancel. Orders not confirmed within 14 days will be cancelled automatically. Quotes not accepted within 31 days will expire and may need to be re-issued.

12. Marketing & Photography

Furnish & Fettle Ltd may take photographs of projects in progress or upon completion, unless you contact us in writing to say that you do not want us to do this. Copyright for these images belongs to the Company. We may use such images for marketing purposes on our website, social media or promotional materials. Personal information and property addresses will not be disclosed.

13. Governing Law

These Terms are governed by English law. Any disputes will be dealt with exclusively in the courts of England and Wales.
